By accessing or using Data Analyzer, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

You must be at least 18 years old to use Data Analyzer. If you are using Data Analyzer on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Data Analyzer is designed for lawful research and data analysis purposes. You agree to use our services only for legitimate research, academic, or professional data analysis activities.

Data Analyzer is an AI-powered platform that provides automated quantitative and qualitative data analysis services. Our platform processes uploaded data files (Excel, CSV, Word, PDF, and other formats) to generate comprehensive analysis reports including statistical analyses, charts, tables, thematic analysis, and interpretations.

We offer both quantitative analysis (statistics, correlations, regressions, significance testing) and qualitative analysis (theme extraction, coding, pattern identification) through our AI-powered analysis engine.

Data Analyzer provides analysis reports that you can download in various formats (PDF, DOCX, CSV, PNG). We do not store your uploaded data files after analysis is complete - all files are automatically and permanently deleted.

To use Data Analyzer, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

You may not share your account with others or use another person's account. Each account is intended for individual use, though team and enterprise plans may have different sharing provisions.

Data Analyzer offers subscription plans (Plus and Pro) with different features and pricing. Subscription fees are billed monthly or annually based on your selected plan.

Subscriptions automatically renew at the end of each billing period unless you cancel your subscription before the renewal date. You can cancel your subscription at any time through your account settings or by contacting support.

All subscription fees are non-refundable except as required by applicable law. If you cancel your subscription, you will continue to have access to premium features until the end of your current billing period.

We reserve the right to change our pricing with 30 days' notice. Price changes will apply to your next billing cycle. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.

Annual subscriptions may be discounted compared to monthly billing. If you cancel an annual subscription, you will not receive a prorated refund for the remaining period.

You retain full ownership of all data files you upload to Data Analyzer and all analysis reports generated from your data. Data Analyzer does not claim any ownership rights to your research data or analysis results.

By uploading data to Data Analyzer, you grant us a limited, non-exclusive license to process your data solely for the purpose of generating your requested analysis reports. This license terminates when your data is deleted from our systems.

You represent and warrant that you have the right to upload and analyze the data you provide to Data Analyzer, and that your use of our services does not violate any third-party rights or applicable laws.

Data Analyzer owns all rights, title, and interest in and to the Data Analyzer platform, including our software, technology, documentation, trademarks, and brand assets. You may not copy, modify, distribute, or reverse engineer any part of our platform without written permission.

You agree not to use Data Analyzer for any illegal, harmful, or unauthorized purpose. Prohibited activities include but are not limited to: uploading malicious software or viruses, attempting to gain unauthorized access to our systems, interfering with platform security or functionality, or using our services to violate any applicable laws or regulations.

You may not upload data that contains personally identifiable information (PII) of others without proper consent, or data that violates privacy laws such as GDPR, HIPAA, or other applicable regulations.

You may not use Data Analyzer to generate content that is defamatory, harassing, discriminatory, or violates intellectual property rights of others. You are solely responsible for ensuring your use of our services complies with all applicable laws and regulations.

You may not attempt to circumvent any security measures, rate limits, or usage restrictions on the platform. Automated access or scraping of our services is prohibited without explicit written permission.

We strive to maintain high service availability but do not guarantee uninterrupted or error-free operation. Data Analyzer may experience downtime due to maintenance, technical issues, or circumstances beyond our control.

We aim for 99.5% monthly uptime for our core analysis services. Planned maintenance will be scheduled during off-peak hours when possible, and we will provide advance notice for significant maintenance windows.

We reserve the right to modify, suspend, or discontinue any aspect of Data Analyzer at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of our services.

We may add new features, change existing features, or remove features as we continue to develop and improve Data Analyzer. We will provide reasonable notice for significant changes that affect your use of the platform.

Data Analyzer processes your uploaded data files solely for the purpose of generating your requested analysis reports. We do not store your uploaded files after analysis is complete - all files are automatically and permanently deleted.

We follow strict data security and privacy practices as detailed in our Privacy Policy. Your research data is never used to train AI models, shared with third parties, or used for advertising purposes.

You are responsible for ensuring you have the right to upload and analyze the data you provide. Data Analyzer is not responsible for any privacy violations or legal issues arising from data you upload without proper authorization.

By using Data Analyzer, you acknowledge that you have read and understood our Privacy Policy, which governs how we collect, use, and protect your information.

The Data Analyzer platform, including all software, technology, algorithms, user interfaces, documentation, and brand assets, is owned by Data Analyzer and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access and use Data Analyzer for your personal or organizational research and data analysis purposes in accordance with these Terms of Service.

You may not copy, modify, distribute, sell, lease, or create derivative works based on Data Analyzer without our express written permission. You may not reverse engineer, decompile, or disassemble any part of our platform.

Any feedback, suggestions, or ideas you provide about Data Analyzer may be used by us without obligation to you. We appreciate your input to help improve our services.

Data Analyzer is provided 'as is' and 'as available' without warranties of any kind, either express or implied. We do not guarantee that our services will be error-free, uninterrupted, or meet your specific requirements.

To the maximum extent permitted by law, Data Analyzer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability to you for any claims arising from these Terms or your use of Data Analyzer shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

You may terminate your account at any time by deleting your account through your account settings or by contacting us at support@dataanalyzer.com. Upon termination, all your analysis reports and account data will be permanently deleted.

We reserve the right to suspend or terminate your account immediately if you violate these Terms of Service, engage in fraudulent or illegal activity, or if we determine that your use of our services poses a risk to our platform or other users.

Upon termination, your right to access and use Data Analyzer will immediately cease. Any provisions of these Terms that by their nature should survive termination will remain in effect, including ownership provisions, warranty disclaimers, and limitations of liability.

If you have any dispute with Data Analyzer, you agree to first contact us at support@dataanalyzer.com to attempt to resolve the dispute informally.

For disputes that cannot be resolved informally, you agree that any disputes arising from these Terms or your use of Data Analyzer will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You agree that any arbitration will take place in Delaware, USA, and will be conducted in English. You waive any right to a jury trial and agree to resolve disputes on an individual basis, not as part of a class action.

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by posting the updated Terms on this page and updating the 'Last Updated' date.

If we make significant changes, we may also notify you via email or through our platform. Your continued use of Data Analyzer after changes become effective constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using Data Analyzer and may delete your account. We encourage you to review these Terms periodically to stay informed about your rights and obligations.
